Least Tern Colony with Nests & Chicks

I know last Year there was a Tern Watch for the Least Tern colony at Fort Lauderdale Beach. Is it rare for the terns to have productive colonies here or just at the beach (1st time in many years)?. I have been following a Least Tern colony of 30-40 birds in Parkland Broward County (County Line Rd - W Hillsboro Blvd http://ebird.org/ebird/view/checklist?subID=S18584781) who over the past several weeks have shown courtship display & copulation. As of today (data not posted yet on ebird) there are a minimum of three chicks and potentially many more active nests. Unfortunately this is an active construction site, can anything be done? Are they protected? The colony is on the South side of W Hillsboro opposite the site for the new Parkland Fire Department ( near NW 117th way & Hillsboro Blvd).
