This bird is under the same influence that any bird that comes to a backyard feeder every morning and afternoon; a hummingbird coming in for sugar water or an owl that comes in to check out a human's mimicking its call. The Red-footed Booby has found a source for food and like any animal will return as long as there is a food source. Obviously the booby is smarter than your logic. So, you simply don't count the Red-footed Booby, it is your choice. But, based on your irrational and illogical reasons your list has to be pretty small. And based on your rationale, a person couldn't count any hummingbird, seed-eating bird or woodpecker pecking suet. As has been discussed on this website, it was already determined that this bird counts under ABA rules. But, again it is your list, just don't make dumb statements about ABA rules when you don't know the facts.
