I do agree with you on caution, Michelle. I am fairly conservative about IDing most empids in the field.
I saw some of the photos of the ACFLs in the hand, and even the yellowest of them (and they were surprisingly yellow!) had light areas on the belly. We had generally poor views of the bird's topside, but no problem seeing underside which was completely yellow from right under the bill all the way to the tail. I don't think any ACFL shows that. The bill also did look smaller, but I recognize that can be subjective when the bird is 30 feet up in the tree.
Toe got that second look, more in profile, and felt even more sure about the ID after that.
