Well sometimes the best way to confirm a birds ID is to go back and relocate the bird. Today I refound my mystery empid and saw it in a different position, at a different angle and in different lighting. This proved that my bird was in fact a very yellowish bellied Acadian Flycatcher. The ID could be confirmed as the bird had a pale greyish throat and a comparatively long tail. It flicked this while keeping its wings still, something that most other empids dont do. Also the bird had very buffy wingbars.
