Good evening Mike et al.,
While I agree that Red-headed Woodpeckers are not a Federally- or State-listed species, they most certainly are a "protected" species. They're protected under the Migratory Bird Treaty Act as well as State statutes.
As such, harassing the birds to obtain photos, etc., in addition to violating the ABA Code of Birding Ethics, is technically a violation of law.
