Small raptor ID

I saw this raptor, about the size of a Mourning Dove. I thought it was a Merlin, as I have seen them in this spot several times before. Yet it never turned around to face me, and its photos suggest it may be a Sharp--shin. It was seen in the Melaleuca snags just west of the bald Eagle nest.
