Paul,

There are two non-plumage characters visible in this photo that eliminate Merlin (or any NA falcon). First, the bill lacks the characteristic "tooth" near the tip that falcons use to cut the spinal cord of their prey, and second all our falcons in the genus Falco have a ring of bare yellow skin surrounding the eye, that is most obvious in front of the eye. This photo shows both of these characters to be lacking.

The bird appears to be a juvenile Cooper's Hawk.
