I get the feeling I'm coming late to a debate that's been settled, but I just got back into town. This bird is a pretty straightforward Eared Grebe: small head with crown peaked above eye, upturned bill, dark cheek with white "ear", rear-end sticking up above the water. And the habitat would be very unusual for Horned, but more expected for Eared. When a Horned Grebe is on fresh water in the winter, it is almost always a large lake. The third photo where the bird is all wet and slicked from a dive is misleading and should be ignored, especially for shape determination.
